General Terms of Sale

This page together with our Privacy Policy and Website Terms of Use tells you information about us and the legal terms and conditions (Terms) on which we sell products to you.
These Terms will apply to any contract between us for the sale of any products listed on our website (Products). Please read these Terms carefully and make sure that you understand them, before ordering any Products from our website.  Please note that by ordering any of our Products, you agree to be bound by these Terms.
This contract will be concluded in English.
Fragonard Perfumery only accepts orders from individual consumers. We are unable to accept orders from under-18s unless they are confirmed by a parent or guardian.

1.    Information about us

We are Fragonard International, a company registered in United Kingdom under company number 09012729 and with our registered office at 109 Gloucester Place, London W1U 6JW, VAT number  GB 217 8091 05

2.    Placing an order

Our ordering process works as follows:
  • Browse our online catalogue at www.fragonard-international.com and add your chosen Products to your basket. You can review and change the contents of your basket at any time.
  • When you are ready to order, navigate to your basket and click the "SUBMIT ORDER" button. You will then be able to check your order and modify it if you wish.
  • If you are a new customer, you must create an account by clicking "CREATE AN ACCOUNT" in the "NEW CUSTOMER" section of our website's sidebar.
  • If you are an existing customer, you should log in using either:
    • your customer number, and password; or
    • your e-mail address and password.
  • After entering your delivery details and payment information, you will be invited to select your free samples (up to a maximum of 3).
  • During the ordering process, you must confirm your acceptance of these terms and conditions by clicking the “I ACCEPT GENERAL TERMS OF SALES” button before proceeding to the payment page.
  • After you place an order, you will receive an order acknowledgement from us by email.  However, please note that this does not mean that your order has been accepted.
  • We will confirm our acceptance of your order by sending you an e-mail [which confirms that the Products have been dispatched] (Dispatch Confirmation). The contract between us will only be formed when we send you the Dispatch Confirmation.

3.    Products

Please note that the list of Products on our website is not exhaustive and that Product images on our website are for information only.
We always seek to ensure that Products listed as available are actually in stock. In the event that a Product which you have ordered is out of stock, our customer services team will contact you within 72 hours. Where Products are unavailable, you may choose to:
  • Cancel your order partially and completely;
  • Receive the Products which are presently available, with the unavailable Products sent in a second delivery; or
  • Receive your entire order in one delivery once all the Products ordered are available.
We will provide you with an estimated delivery date for any Products which are not immediately available.

4.    Prices

The prices of the Products are in £ (pounds) set out on our website from time to time. We take all reasonable care to ensure that the prices of Products are correct at the time when the relevant information is entered onto the system. However if we discover an error in the price of Product(s) you have ordered, we will inform you of this error and give you the option of continuing to purchase the Product(s) at the correct price or cancelling your order.

The price of a Product includes VAT (where applicable) at the applicable current rate chargeable in the UK for the time being. If the rate of VAT changes between the date of your order and the date of delivery, we will adjust the VAT you pay (unless you have already paid for your order in full).

You are responsible for paying any applicable customs duties, import duties or domestic taxes, including those payable at the point of delivery.
We may revise the prices on our website at any time without notice to you but these changes will not affect any price we have confirmed on your Dispatch Confirmation.

Delivery

Deliveries are available only in the UK territory except Jersey, Guernsey, Island of Man.

Standard delivery to the United Kingdom starts from £4.50. Delivery charges are displayed on our website prior to confirmation of your order.

Orders will be delivered to the address you provide during the order process, using the selected method of delivery. We recommend to pay attention to mentioned all the necessary details to ensure the delivery. We reserve the right to split deliveries but, where we do so, we will not charge any additional delivery fees.

Please note that our system does not allow us to combine multiple orders with the same delivery address, even where placed on the same day. Where multiple orders are placed, each will be subject to its own delivery charge.

Delivery times

All orders will be delivered within 30 days of receiving full payment, or on an earlier date as notified to you online or in your Dispatch Confirmation.
Please note that delivery times are estimates only but if your order is delayed by more than 30 days we will inform you as soon as possible and offer you the opportunity to cancel your order in full or in part.

5.    How to pay

Online payment by credit card

Our online store accepts credit cards issued by Mastercard, and Visa. Credit card payments require the card number, expiration date and security code on the back of the card (the last 3 digits on the signature panel). You will never be asked to provide your PIN.

Our online store uses industry standard SSL encryption. All credit card information held on our servers is stored in encrypted form.

If the value of your order exceeds £150, we reserve the right to require payment by bank transfer, or to request a copy of an identity document or proof of address. Orders will be processed upon receipt of payment and/or applicable documentation.
We also accept credit card payments via the following methods:
  • By phone at 0800 612 5065: we are available by telephone on weekdays from 9:00am to 12:00pm, and from 2:00pm to 5:00pm (French time).
All credit card information will be held on our secure payment system, ensuring strict confidentiality. Credit card details must be re-entered for each order.

We also accept payments via bank transfer. Our bank details are as follows:

International money order

We accept money orders made payable to FRAGONARD INTERNATIONAL. When making payment via money order, please provide the date and order number provided on your order confirmation.  

PayPal

We accept payment via PayPal for online orders. To pay via PayPal, click on the PayPal logo at the final stage of your order. You will then be redirected automatically to the PayPal site.

6.    Returns and Refunds

Faulty products

If the item you have received is defective, please notify us promptly and return the item in accordance with the "How to return products" section 6 below.

Changed your mind?

You may return Products ordered from us for any reason, providing that you inform us of your intention to return the Products within 20 days of receiving them. The 20-day period commences when you take possession of the Products (or a third party, excluding our courier, takes possession on your behalf). This return period exceeds the 14-day period required under the Consumer Contracts Regulations.

To exercise your right of return, you must contact our customer service team within 20 days of receiving the Products to let us know you wish to return them. You may do so through the following means:

Please note that on the grounds of hygiene, certain Products cannot be returned once they have been opened.

How to return products

Products must be returned in a reasonable condition, unopened and unused together with any accessories supplied. You should return Products to us without undue delay and in any event, within 14 days of informing us of your intention to return them.

You are responsible for paying delivery charges incurred when returning Products to us (except where we have sent you an item in error or an item is defective).

We will not be responsible for any loss or damage to Products during their return transit and we recommend that you use a secure delivery method and obtain proof of postage.

Refunds

We will, for any Products deemed defective, provide a full refund for the Products (including the delivery charge) and any reasonable postage and packaging costs you incur in returning the item to us).

Where you have cancelled your order within 20 days (for example, because you have changed your mind about a Product), we will reimburse the cost of the Products which are returned, plus, if you are returning all items in your order, the cost of the least expensive method of standard delivery available for those Products. We will not reimburse additional delivery costs incurred where you have chosen a more expensive method of delivery.

Please be aware that we are permitted by law to reduce your refund to reflect any reduction in the value of the Products if this has been caused by your handling them in a way which would not have been permitted in a shop.

Upon receipt of returned Products, we will issue a refund promptly and in any event within 14 days. Refunds will be applied to the payment method used for the original transaction, unless we expressly agree to use a different method. We do not charge a fee to process refunds.

7.    Our Liability to You

Nothing in these Terms shall exclude or limit our liability with regard to any matter for which it would be unlawful for us to limit or exclude our liability.

If we breach these Terms, we shall only be liable for losses which are a reasonably foreseeable consequence of such breach.  We are not responsible for indirect losses which are a side effect of the main loss or damage, for example loss of profits or loss of opportunity.

We shall not be liable for failure to deliver the Products or to meet any of our other obligations under these Terms where such failure is due to an event that is beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident and terrorist activity.

Our maximum liability to you for any loss or damage arising in connection with your order shall be limited to the total price of your order.

8.    Applicable Law

When purchasing goods from us, you agree that your contract with us is subject to English law and that any disputes (contractual or non-contractual) will be subject to the exclusive jurisdiction of the English courts.

9. Your personal data


Your data is processed by the company Les Parfumeries Fragonard, which is enrolled in the Grasse Commercial Register under number 403 394 018.

We promise to protect your privacy when you use our website and we ensure the confidentiality of the personal data that you give us. We need this information to process and manage your orders properly. When you place an order, we need to know your first and last name, mailing address, email address, and mobile number to manage the shipment of your package. This data allows us to process your order and inform you of its status. Please note that we do not store your bank information.

We collect your data with your consent to send you special offers via email or SMS, as well as our catalogues and samples via the post. We will store your data for a maximum of 3 years after your last response to our solicitations. The legal basis for this processing is your consent, which you may withdraw at any time, without this impairing the lawfulness of the processing of your data made before such a withdrawal.

In accordance with the General Data Protection Regulation No. 2016/679 of 27 April 2016, you have the right to request Les Parfumeries Fragonard to access, correct, transfer, or erase your personal data, as well as to limit or object to its processing. You also have the right to file a complaint with the French National Commission on Informatics and Liberty, or CNIL, at: https://www.cnil.fr/.
